Does Becoming American Affect My Canadian Citizenship? (3)

You automatically receive Canadian citizenship when you are born in Canada. You are also considered a citizen if one of your parents is a first-generation Canadian citizen. Citizenship can also be obtained by a person who has obtained permanent residence in Canada then lived in the country for a certain time period. Their children are also considered Canadian citizens, even if they are born in another country.

Canada is a country that allows dual citizenship. A Canadian will not lose their citizenship if they take on another nationality or nationalities. If they are naturalized as a citizen, they will retain their original citizenship in addition to their Canadian citizenship, provided that the other country also allows dual citizenship. The United States of America also allows dual citizenship.

Benefits of Dual Citizenship (Canada & USA)

Here are the benefits of dual citizens holding a Canadian and American citizenship:

  • Possessing two passports can make border-crossing go more smoothly.
  • You can vote in either country.
  • You can move freely between and live in either of the two countries.
  • Benefit from the rights and privileges of each country.

Requirements

The first thing you need to do is make sure you’re eligible to have citizenship in both countries.

Keep in mind that your parents’ country of origin also extends their citizenship to you. For example, if your mother was born in Canada and your father was born in the United States, you would already have dual citizenship without having to do anything other than register as a citizen.

If that’s not the case for you, you’ll need to follow certain requirements:

  • Rules for immigrating to America.
  • You’ll need to apply for a green card, which is what allows you to initially live in the country permanently. Your eligibility for a green card can be based on having family members who are permanent residents or citizens. It can also be work related. If you have an offer from a company that cannot find an American citizen with the appropriate skill set, you can obtain a green card. Having $1 million to invest in an American business will also give you eligibility.
  • You’ll need to live in America for a legally specified period of time before you can apply for citizenship.
  • You cannot have been convicted of a crime.
  • Rules for immigrating to Canada.
  • You’ll need to apply for permanent residency. Similar to the rules for immigrating to America, having relatives that are permanent residents or citizens can allow you to obtain permanent residency for yourself. The categories for skilled workers and business investment could also potentially make you eligible, as well.
  • You’ll need to live in Canada for four out of six years.
  • You cannot have been convicted of a crime.

Both countries will require an application, as well as a language test. In order to become an American citizen, you need to be able to understand English, while the Canadian citizenship test requires you to understand French or English.

You’ll want to find a qualified immigration lawyer to help you with the process. One who also specializes in citizenship revocation will be particularly helpful if you run into any issues with your application.

As a new comer for Canada, I needed some serious guidance and help with my work permit and immigration issues in 2021. After talking to several consultants in downtown Toronto, we chose to let Matthew's firm help us with our applications. What prompted me to the decision is his openness and his deep knowledge of the intricacies of the nature of an immigration case. Thanks to him and his colleague, I was able to get past my anxiety and focus on getting the paperwork ready for my application. Although our situation had some issues with some members withdrawing from the initial application, Matthew did a great job helping me resolve any problems and clearing any doubts coming from IRCC. We were able to navigate through the delays due to COVID and successfully obtain our PR this year. I want to also give my special thanks to Ms. Crystal Xu for her attentiveness as her comforting demeanor helped me through many restless and anxious nights. I highly recommend any new comers in need of immigration help to consider Matthew's firm. Their professional competence and integrity was worth every penny. Thank you Matthew for helping me with my journey in Canada!

THE BEST LAWYER IN CANADA. I not only recommend Matthew best, but I guarantee once you have used his services you too will look no further. Matthew represented my mom in an immigration matter that started last year. My mother’s case was really complicated and other lawyers didn’t know where to begin or how to help my mom. After trying a couple different lawyers (who didn’t care about anything EXCEPT getting as much money from you as they could), and thanks to them for considering her case as hopeless one and refused to represent her, I finally met Matthew. He is extremely knowledgeable, a great communicator, efficient and truly represents best interests of his clients. He was available anytime we needed him and always made sure we were on top of what we needed to do. I honestly from the bottom of my heart can say that Matthew is the best lawyer and most decent person you can meet. He actually sincerely CARES about an outcome of your case. There is no other attorney that will work as hard for you. You will be surprised how much effort he puts in your case and what a great job he does. If he takes your case, be confident that he will do everything and will win it. Thank you so much Matthew, for all your help and hard work.

Honestly the best lawyer and law firm in Toronto and surrounding area. Had bad experiences with a few lawyers who promised with words with no proper actions. Mr. Matthew took good care of my sponsorship case personally himself , to make sure my file and application was completed. Nice, highly professional respectful person, a man of his word. His team are professionals. They have great communication skills and manners. I had the chance to deal with Mrs. Crystal Xu and she was very understanding, supportive and knowledgeable as well as Mrs. Maryam. Always kept me posted and updated. All the efforts and detailed professional work was successfully and highly appreciated. An honest advice for anyone, don't waste your time with other law firms (as i tried most of them the big names) and just go with Mr. Matthew and save your time, money and effort. I can't thank you guys enough. All the best to you all!

I highly recommend The Law Office of Matthew Jeffery. Having work with him and his team has literally changed my life. He is very efficient; they communicate effectively and always promptly. He assisted me with a Humanitarian and Compassionate grounds case. I am glad that I trusted the future and life of my family to him. I am glad that I did not listed to people who advised me that the likelihood of getting this case accepted was low. The lawyer who I was working with, believed in my case and helped me in every step of the way. The time that we waited for and the money that we spent on is an investment that will make a better life not only for me, but also for my kids. Thanks to John Laman and Jeffery for always staying on top of my case and answering all my questions and concerns. I cannot recommend them more for your immigration law needs. Thanks.

My husband and I have just received approval of permanent residency. We had a 5 star experience dealing with Crystal Xu. She has made what was an extremely stressful situation completely stress free. Every single step of the way on our permanent residency journey she was there no matter what day or time it was. She was always on the other end of the phone any time I had any kind of question to ask. I thought it would take much longer for our visa to come through but thanks to crystal the process was less than a year which is amazing considering all the delays with the pandemic. We hit a couple of bumps in the road along the way and she would smooth it all over in no time. Crystal was extremely professional and knowledgeable on all things visa. Also the paperwork side of things were very daunting for me before I contacted her. She made it all so simple and explained it all so thoroughly. She was amazing at keeping me calm when ever I had any moments of panic. We are now just waiting to receive our PR cards in the mail thanks to her. I would highly recommend her to anyone. We will not be going to anyone else but Crystal in the future when it comes to applying for out citizenship. My husband and I are so grateful to have found her and look forward to working with her again in the future.
