Retirement age spreadsheet from 2023 for employees working under normal conditions in Vietnam?

According to the provisions of Article 4 of Decree 135/2020/ND-CP, the retirement age of employees under normal working conditions according to Clause 2, Article 169 of the Labor Code of Vietnam is specified as follows:

Retirement ages of employees under ordinary working conditions as prescribed in clause 2 Article 169 of the Labor Code of Vietnam are specified as follows:

1. Since January 1, 2021, the retirement age of employees under ordinary working conditions are 60 years 3 months for male employees and 55 years 4 months for female employees; and the age increases by 3 months for male employees each successive year until he reaches 62 in 2028 and increases by 4 months for female employees each successive year until she reaches 60 in 2035.

What is the retirement age calculation from 2023 for employees working in heavy, toxic, and dangerous conditions in Vietnam?

According to the provisions of Article 5 of Decree 135/2020/ND-CP, employees in the following cases may retire at a lower age but not exceeding 05 years old than the retirement age in Vietnam specified in Article 4 of this Decree at the time of retirement, unless otherwise provided for by law:

- An employee, in any of the following circ*mstances, may retire at the age earlier but not exceeding 5 years before the statutory retirement age in Vietnam provided for in Article 4 hereof, determined until the retirement date, unless otherwise prescribed by law:

+ He/she has at least 15 years’ doing laborious, toxic and dangerous occupations or highly laborious, toxic and dangerous occupations on the lists of the Minister of Labor, War Invalids and Social Affairs.

+ He/she has at least 15 years’ working in highly disadvantaged areas, including the period he/she works in areas with the region-based allowance of at least 0.7 (allowance for those working in disadvantaged areas) before January 01, 2021 on the list of the Minister of Labor, War Invalids and Social Affairs.

+ His/her work capacity reduction is at least 61%.

+ He/she has at least total 15 years’ doing the occupations specified in point a and working in the areas specified in point b.

- Female cadres and civil servants holding the following positions and titles:

+ Deputy Heads of Party committees and agencies at the central level; Deputy Director of Ho Chi Minh National Academy of Politics, Deputy Editor-in-Chief of People's Newspaper, Deputy Editor-in-Chief of Communist Magazine;

+ Vice Chairman of the Central Committee of the Vietnam Fatherland Front;

+ Vice Chairman of the Ethnic Council, Deputy Chairman of the Committees of the National Assembly, Deputy Chairman of the National Assembly Office;

+ Deputy Chief Justice of the Supreme People's Court, Deputy Director of the Supreme People's Procuracy;

+ Deputy minister, deputy of the head of the ministerial-level agency;

+ Deputy Head of the Office of the President, Deputy State Auditor General;

+ Deputy heads of socio-political organizations at the central level;

+ Deputy Secretary of provincial committees, city committees, party committees directly under the central government; Presidents of People's Councils, Presidents of People's Committees of provinces and centrally-run cities;

+ Member of the Central Inspection Commission;

+ Director of The National Political Publishing House of Truth;

+ Director of the Institute of Legislative Studies under the Standing Committee of the National Assembly;

+ Director of Hanoi National University, Director of Vietnam National University Ho Chi Minh City, General Director of Vietnam Social Insurance, Head of Management Board of Ho Chi Minh Mausoleum, Chairman of National Financial Supervisory Commission; Vice Chairman of the State Capital Management Committee at the enterprise;

+ Vice Chairman of the People's Council, Vice Chairman of the People's Committee of Hanoi and Ho Chi Minh City;

+ Permanent members of the Council of Nationalities and committees of the National Assembly;

+ Member of the Standing Committee Head of Party Committees of Hanoi and Ho Chi Minh City;

+ Members of the Standing Committee of provincial committees and city committees are ethnic minorities.

- Civil servants are appointed as Judges of the Supreme People's Court and Procurators of the Supreme People's Procuracy.

*In case the officer retires at a higher age

Subjects of employees retiring at a higher age specified in Article 2 of Decree 50/2022/ND-CP include:

- Officers with the rank of Professor and Associate Professor;

- Officers holding professional titles whose qualification requirements are Doctorates or Specialty II;

- Forensic examiner, a psychiatric forensic examiner;

- Officials with high expertise and technology in a number of specific career fields in accordance with specialized laws.
