Can a Property or Condo Be Vacated to Sell It?

Landlords may not terminate tenancies solely in order to sell properties vacant in the City of West Hollywood.

Landlords of condominiums and single unit properties cannot perform owner-occupancy evictions if they are selling the property. The owner has to intend to occupy the unit for a year or more as their primary place of residence. A landlord who is selling the property cannot show this intent. A buyer who wants to owner-occupy the unit, may relocate the tenant at the close of escrow in compliance with the owner-occupancy relocation for condominiums. If a condo or single unit property is being sold following a foreclosure sale, there are also limitations on the ability to relocate a tenant.

Landlords who tell their tenants that they must move out because the unit or property must be delivered vacant to a buyer should be aware that: Misrepresenting or concealing material fact to entice a tenant to vacate a unit may result in investigation for tenant harassment. Cases for which there is sufficient evidence are referred to the City Prosecutor and may lead to criminal charges being filed.
