How do I fight a writ of execution in California? ›

The most effective way to stop a writ of execution is to ask the Judgment Creditor to stop it. The sheriff will often back off if the parties are working to resolve the judgment. We have plenty of experience in settling judgments. Another sure fire way to stop a writ of execution is to file for Bankruptcy.

A writ of execution may require a bank to deny a debtor access to his or her funds and instead provide that money to the creditor. The court may also direct an employer to take part of the debtor's wages and send them directly to the creditor.

If by “bank execution” you mean a garnishment against a checking, savings, or other account, it would be returned to the Court unsatisfied if the account doesn't exist, doesn't have funds available, or has funds that are exempted by Federal law and protected from garnishment.

A writ of execution allow the debtor's non-exempt property to be seized and sold. The proceeds from the sale go to the debt owed to the creditor. Some of the Texas justice courts have a form to request a writ of execution available on their website.

Some federal judgments are good for 20 years before a renewal is required. However, some states have decided to use their own limits: for example, in Florida, the limit is five years. Generally, one must wait two weeks before starting to enforce a federal judgment.

If you know where the Judgment Debtor banks, you can ask the Sheriff to collect money from their account (bank account levy). If you know where the Judgment Debtor works, the Sheriff can collect 25% of the debtor's wages each pay period until your judgment is paid in full (wage garnishment).
