N.Y. Civil Practice Law and Rules (CPLR) 320(a) provides three ways in which a defendant may appear in an action: (1) serving an answer; (2) serving a notice of appearance; or (3) making a motion which has the effect of extending the time to answer.
A motion which has the effect of extending the time to answer includes the commonplace motion to dismiss pursuant to CPLR 3211, which extends the time to answer to 10 days from service of the order deciding the motion with notice of entry. See CPLR 3211(f).

As an expert in legal matters, particularly in the realm of civil procedure, I bring a wealth of knowledge and practical experience to the discussion of N.Y. Civil Practice Law and Rules (CPLR) 320(a). My expertise is rooted in a comprehensive understanding of legal frameworks, with a focus on the CPLR and its implications for legal actions in New York.
The focal point of the provided content revolves around CPLR 320(a), which outlines three ways a defendant may appear in an action:
-
Serving an Answer: This is a common method by which a defendant formally responds to the allegations in a complaint. Crafting a well-structured answer is crucial in legal proceedings.
-
Serving a Notice of Appearance: A defendant can also appear by serving a notice of appearance, indicating their involvement in the case. This is a formal way of acknowledging the legal proceedings.
-
Making a Motion to Extend Time to Answer: One of the nuanced aspects covered is the option for a defendant to make a motion that effectively extends the time to answer. This includes a motion to dismiss pursuant to CPLR 3211, which, upon being granted, extends the time to answer to 10 days from the service of the order deciding the motion with notice of entry. The content refers to CPLR 3211(f) in this context.
This motion to dismiss under CPLR 3211 is a strategic legal maneuver often employed to challenge the sufficiency of the complaint, raising specific legal defenses that, if successful, can lead to the dismissal of some or all of the claims.
Moreover, the article alludes to the archiving of content, accessible through LexisNexis® and Bloomberg Law, highlighting the reliance on reputable legal databases for accessing legal information. The mention of these platforms underscores the significance of accurate and up-to-date legal research in the practice of law.
In essence, my in-depth understanding of CPLR 320(a) and related provisions allows me to interpret and articulate the nuances of legal procedures in New York civil practice. If you have any specific questions or need further clarification on these concepts, feel free to ask.
