You have nothing that a creditor with a judgmentcould take from you, in either assets or income:that is, if everything you have is exempt underthe laws of your state, including your source ofincome, you have nothing to lose to a creditorand no need for bankruptcy protection now.However, it's important torealize that just because the creditor hasnothing to attach right NOW, that doesn't mean those debts can't come back tohaunt you in the future. Is this just a temporary financialglitch? Then you might want to consider filing. In the future, are you going to be substantially better off? New job?Extra Income? More assets? Do you own a home and are in danger of losing it? Seeour article regarding alternatives and possiblesolutions to Foreclosure Remember, yourarely have to lose your home.Even though, Bankruptcy should be a last resort, if allelse fails, a Chapter 13 will almost always allow you tosave your home. SHOULD YOU FILEBANKRUPTCY NOW OR LATER? I had a closepersonal friend who came to me wanting to buy a home.During the loan process we found that he had absolutelyimpeccable credit. Unfortunately, his income was onlyslightly more than his outgo, (as in about $100 permonth, and this was before food and utilities!),. My first question to him was how are you managing tomake all your payments on time. I had never seen anyoneso overloaded with debt while making their payments soflawlessly. He informed me that he was effectivelyborrowing from Peter to pay Paul. Borrow from onecredit card to pay another, then open another creditaccount to pay the last... Underthese circ*mstances, there was no way that he couldqualify for a normal loan. He only wanted around an$80,000 home, but even with the $8,000 down he wasgetting from a settlement, he could not qualify for aconventional low rate loan. His expenses vs income wasjust too high. As Iexplained to him, with his income to debt ratios, hewould never be able to buy a house. At least, notwith a fixed rate or reasonable down payment. Wewere going to have to get creative. I thenexplained to him that with his situation-- Namely,the fact that every month he was going further andfurther into debt. His minimum payments on thecredit cards were getting larger and larger-- Hisincome was staying relatively stagnant. He wasunquestionably spiraling into the need for abankruptcy. The only realquestion was would it be now or later? Here's what we did. We used his $8,000 insurancesettlement for his down payment. I persuaded the sellerof the property to carry $12,000 for a term of 30months. Now, that we only needed a loan for $60,000 onan $80,000 home, We were able toget him a loansecured by the property. It was not a good loan, but aloan, nevertheless. This loan was fixed at 6%, but foronly two years. After that it would adjust to about12%, thus increasing my friends payment by about $300per month over the original payment.Generally, I wouldn't negotiatethis deal for my worst enemy, but we had a strategy thatwould insure that he would never have to pay that highinterest rate. NOTE:Ifa person files Bankruptcy and then from the date ofdischarge, keeps any new or reaffirmed debts paidperfectly, for most lenders, in two years, they willbe considered to again be a good credit risk. We closed the deal, he now owned the homeand he then immediately filed Bankruptcy. So he discharged hisunsecured debt, and reaffirmed his home andcar loan. (i.e. continued to make payments on homeand car). NOTE:There are now loan programs that will allow you toget a home loan within 6 monthsafter bankruptcy or even one day with a substantialdown payment. SeeHomeLoans At the end of two years,he had paid his remaining bills perfectly. Additionally, because he had all of the unsecured debtsdischarged, his monthly obligations were reduced byabout $600 per month. He now had good credit andincome to debt ratios that were reasonable, so he couldnow refinance his home and get rid of that firstmortgage that was getting ready to go to 12%-- plus,because his home had appreciated, we could even pay offthe $12,000 that he still owed the seller. Because hisfinances were now in balance I was able to get himapproved for a refinance to do the above at a fixed 6%interest rate loan. Amazingly enough-- this was one of those rare situationsin which the only way to accomplish thegoals of home ownership for himself and his family, wasby filing Bankruptcy! *********************************************************************************************************** Back to Top! IS DOING THERIGHT THING, THE WRONG THING FOR YOUR FAMILY? Doingthe right thing is always admirable.But it has been my experience that sometimes doing theright thing for the creditors is absolutely the wrongthing for your family... I was recently contacted by a family that had beenstruggling with debt for 3 years. Prior to thebeginning of their problems they had both had very goodjobs. As with most of us, good jobs equal goodlifestyle and lots of debt. Their income was such thatthey were not overloaded in the least.... but then helost his job, the family income was halved for aboutsix months. They had some 30 day lates, but nothing tooserious. He finally found other employment-- justabout the time that she lost her job!... Overthe next three years, for both of them, employment wassporadic. In their attempt to do the "right thing"i.e. keep their home, pay their bills, even if late... theydrained not only their savings, but raided their retirement accounts (Whichyou can almost always keep when you file Bankruptcy), To makematters worse, dipping into retirement accounts, carried earlywithdrawal penalties and extra tax liabilities, (we managed to avoid most of thepenalties on an amended tax return), but the point is that they werefinancially drowning. At all costs, they were determined to avoid bankruptcy.They wanted to do the right thing and pay theircreditors. They continued their spiral and sporadicemployment for three years. Thiswas admirable and I respect them immensely for theirintegrity. But now,they have nothing left. Even theirretirement is gone! Their home was in foreclosureand to keep the home, for themselves and daughter,they finally decided to file a chapter 13bankruptcy.
