Why is gambling not legal in India? ›

Legality. Gambling falls under the jurisdiction of individual states, with only Indian states empowered to legislate on gambling within their boundaries. The Public Gambling Act of 1867, a central legislation, specifically prohibits the operation or management of public gambling establishments.

Whoever is found in any such house, walled enclosure, room or place playing or gaming with cards, dice, counters, money or other instruments of gaming, or is found there present for the purpose of gaming, whether playing for any money, wager, stake or otherwise, shall be liable to a fine not exceeding one hundred ...

Contrary to popular belief, gambling isn't universally legal across the country. The right to regulate gambling is left to individual states, not the federal government. As of now, only two states—Utah and Hawaii—have completely banned all forms of gambling.

Under the State Gaming Enactments

The Public Gambling Act 1867 (the “PGA”) has been adopted by certain states in India, whereas other states have enacted their own pieces of legislation to regulate betting and gambling activities within the state (the “State Enactments”).

While gambling is forbidden in India, the Public Gambling Act of 1867 (“Gambling Act”) makes no mention of online gaming.

According to these guidelines, only online games that do not involve betting, contain content that could potentially harm children, or cause addiction can be registered or approved. This stipulation implies that most real-money games, including roulette and slots, are not permissible.

If state-run lotteries are included, then 48 states allow some form of gambling (the exceptions are Hawaii, where gambling was outlawed prior to statehood, and Utah, which has a Latter-day Saint majority population and also bans gambling in the state constitution).

Not surprisingly, with the city of Las Vegas, Nevada took the number one spot as the most gambling-addicted state.

In 1987, the Supreme Court held that once a state has legalized any form of gambling, tribes within that state can offer the same game on tribal land held in trust by the United States without any state regulation (see California v. Cabazon Band of Mission Indians, 480 U.S. 202 (1987)).
