Why are foreigners banned from buying houses in Canada? ›

Enacted Jan. 1, the ban is intended to cool Canada's white-hot housing market by freeing up supply for priced-out locals. Despite its fearsome name, the Prohibition on the Purchase of Residential Property by Non-Canadians Act isn't all-encompassing, however.

On January 1st, 2023, the foreign home ownership ban—formally known as the Prohibition on the Purchase of Residential Property by Non-Canadians Act—went into effect in Canada.

This means non-Canadians are now able to purchase this land and use it for any purpose, including residential development. Additionally, another exemption is being made to allow foreigners to buy residential property for the purpose of housing development.

The Act limits non-Canadians from buying residential property in Canada until January 1, 2025 to try to address the current shortage of residential housing and make homes more affordable for Canadians citizens and permanent residents.

Broadly speaking, the Act prohibits "non-Canadians" from purchasing any residential property directly or indirectly from January 1, 2023, to December 31, 2024.

In Canada, both permanent residents and non-permanent residents are permitted to purchase property under certain conditions; for instance, if they hold a work permit. However, becoming a homeowner won't give you access to permanent residency and won't change the terms of your visa.

Known as the foreign buyer ban, the goal of the legislation and regulations, passed by Parliament in 2022, and in force on January 1, 2023, was to help make housing more affordable by ensuring Canadians had more access to homes for sale by taxing underused foreign-owned homes.

U.S. residents can own property in Canada without becoming a resident of Canada, but must report income or proceeds from a sale to both country's taxing authorities. Canadian banks offer mortgages and home equity loans with similar financing terms to those extended in the U.S.
