Landlord and Tenant Rights and Responsibilities
questions & answers
Question: My landlord sent me a lease renewal notice that indicated the rent would go up. We had a verbal agreement last summer when I renewed that my rent would stay the same. When I told my landlord that I planned to renew but asked if my rent would stay the same, she sent me a non renewal notice for my lease. Does this qualify as retaliation?
Answer: In my opinion, a verbal agreement to keep the rent the same is not binding a year later. The landlord is unfortunately not under any rule or law that they have to renew your lease. They can choose to not renew for any reason or no reason, except discrimination. I don't think this is retaliation.
