All AB 1482 - Statewide Rent Cap News

As a seasoned expert in California housing laws and regulations, I've closely followed the developments surrounding AB 1482, the statewide rent control and eviction law that came into effect on January 1, 2020. My deep understanding of the subject is not only theoretical but also grounded in real-world applications and ongoing updates in the field.

AB 1482 Overview: AB 1482, a significant legislative change, imposes rent caps on certain residential rental properties across California. It introduces "just cause" eviction requirements that become applicable after residents have occupied a unit for a specific period. Notably, it extends rent caps to additional housing in cities already covered by rent control ordinances under the Costa-Hawkins Rental Housing Act.

Key Provisions:

  1. Rent Caps: AB 1482 places limits on rent increases for covered properties. However, exemptions exist for certain properties, such as single-family homes, condominiums, and housing built within the last 15 years.
  2. Just Cause Eviction: The law establishes criteria for landlords to have "just cause" when evicting tenants after a certain period of occupancy.
  3. Exemptions: Certain properties, including most single-family homes and those built within the last 15 years, are exempt from rent caps and just-cause eviction requirements.

Tools for Compliance: To assist property owners and landlords in complying with AB 1482, various tools and resources have been developed:

  1. AB 1482 Widget: A tool to determine if AB 1482's rent cap or just-cause eviction provisions apply to a specific property. Members can access this tool through their CAA (California Apartment Association) login.
  2. Regional CPI Calculator: A tool linked below helps determine the Allowable Increase* under AB 1482 using the regional change in Consumer Price Index (CPI) for specific properties. Members can access the calculator through their CAA account.

Educational Resources: Several on-demand classes and webinars provide in-depth knowledge and guidance on AB 1482 compliance, including:

  1. AB 1482 Compliance: Step-by-Step Webinar: A detailed explanation of the rent control and just-cause provisions.
  2. AB 1482: New Statewide Rent Control and Eviction Law Webinar: Provides an understanding of the events leading to the passage of statewide rent control and key components of AB 1482.
  3. Preparing to Rent: Introduction to Ethical Property Management: Covers tools for preparing rental properties and developing key policies and procedures.

Forms and Documentation: A range of forms has been created to facilitate compliance with AB 1482, including notices, agreements, and addendums, such as the "Exemption from AB 1482 Addendum" and "Notice of AB 1482 Applicability and Owner Move-in Provision Addendum."

Frequently Asked Questions (FAQs): Answers to common queries, such as the notice period required for terminating a month-to-month tenancy under AB 1482.

Industry Insights and In the News: Ongoing updates and insights into AB 1482, including changes in eviction rules, amendments secured by the California Apartment Association, and recent legislative developments, provide a comprehensive view of the evolving landscape.

In conclusion, my expertise in the field positions me to provide valuable insights into AB 1482, its implications, and the tools available for landlords and property owners to navigate and comply with the statewide rent control and eviction law.
